Indeed, developing any copyrighted work on commission, transferring ownership rights, or granting the right to use the work requires the establishment of a contract.
Copyright contracts should transparently and clearly describe the rights and obligations of each party, which will help avoid disputes in the future.
Depending on the situations, you may need to enter into the following types of contracts:
Contracts for the transfer (alienation) of property rights to a work with individual authors of copyrighted objects.
Contracts between legal entities for the transfer of property rights to copyrighted objects.
Commission contracts between legal and individual entities – artists, designers, photographers, etc.
However, this list is not exhaustive, as each contract reflects the diverse needs of participants in the market, and therefore, an individual contract is created for each specific request.
Certain contracts can be registered with the Ukrainian Intellectual Property Institute (UKRNIIP), and the registration process usually takes 2-3 months.
